Terms and conditions

The Rental Agreement is made between Alto car hire/Christoforos Botsis and Co. (hereinafter referred to as “the Lessor”) and the person and/or company signing the Rental Document or accepting the terms and conditions option through the company website www.altocarhirecorfu.com (hereinafter referred to as “the Renter”) whose details are recorded in the Rental Document. It is hereby agreed as follows:
1.VEHICLE DESCRIPTION AND TERM OF HIRE
1.1. The Lessor will let and the Renter will take the Vehicle, (hereinafter referred to as “the Vehicle”), for the term of hire as described in the Rental Document. 2.PERSONS WHO MAY DRIVE THE RENTAL VEHICLE 2.1. The Vehicle may be driven during the term of hire only by the persons named on the Rental Document, and only if they hold a current valid EU or International driving licence held for at least 1 year. For non EU countries an international driving licence is required as stated in the Vienna Convention on Road Traffic or a national driving licence accompanied with an IDP (international driving permit) booklet. The Renter must present his driving licence in physical form upon collection, failing to do so will immediately terminate the rental agreement and the Lessor is not obligated to refund the Renter for any loss.
3.PAYMENTS BY RENTER
3.1. The Renter shall pay the Lessor for the hire of the Vehicle the sum or sums specified in the Rental Document. 3.2. In addition to the payment specified in clause 3.1 above, the Renter acknowledges that they shall be liable at the end of the hire term to pay to the Lessor any applicable additional charges payable at the end of the term. These include, but are not limited to: a) a fee to cover additional drivers. b) charges for petrol or other fuel used. c) charges for late return of the Vehicle. d) charges for damage to or repair of the Vehicle (subject to the other terms of the Rental Agreement); and any enforcement charges relating to such damage or repairs (including legal costs). e) charges for cleaning the Vehicle’s interior if the Vehicle is returned in an excessively dirty condition that requires extra cleaning or deodorising. This includes, but is not limited to, spillage of fluids, food, vomit, other stains, and unpleasant odours including cigarette smoke; 3.3. If the Renter fails to pay any money due under or in connection with the Rental Agreement within 7 days of the date by which the Renter was required to pay the money, the Lessor may, without prejudice to any other rights or remedies the Lessor may have or be entitled to, charge the Renter penalty charge at 10% (compounded daily) on the total amount owing from the expiry of 7 days from the date on which the Renter was required to pay the money to the date of payment; 3.4.The Renter solemnly declares that he possesses enough property to cover any financial obligation he may incur against the Lessor as a result of the rental agreement.
4.USE OF THE VEHICLE
4.1. It is forbidden that the renter : a) Use the vehicle for any illegal transport of goods or any purpose violating the Greek law. b) Use or allow the Vehicle to be used for the transport of passengers or property for hire or reward. c) Sublet or hire the Vehicle to any other person. d) Take the vehicle off the island of Corfu. e) Operate the Vehicle or allow it to be operated in circumstances that constitute an offence against the law (which relates to driving under the influence of alcohol or drugs). f) Operate the Vehicle or allow it to be operated in any race, speed test, rally or contest, or any motor events. g) Operate the Vehicle, or allow it to be operated, in breach of rules and regulations or bylaws relating to road traffic. h) Operate the Vehicle or allow it to be operated for the transport of more passengers or goods than the maximum specified in the certificate of loading and/or road user charge certificate, whichever is the lesser, for the Vehicle. i) Drive or allow the Vehicle to be driven by any person if at the time of driving the Vehicle the driver does not hold a current full valid driver’s licence appropriate for the Vehicle and is named on the Rental Document. j) Drive or allow the Vehicle to be driven on non asphalt-coated roads; k) Operate the Vehicle or allow it to be operated to propel or tow any other Vehicle; l) Operate or allow the Vehicle to be used in involvement with any illegal activity. m) Allow any person to smoke in the Vehicle.
5.RENTER’S OBLIGATIONS
5.1 The Renter shall ensure that: a) All reasonable care is taken when driving and parking the Vehicle. b) only the fuel type specified for the Vehicle will be used. c) The tyres are maintained at their proper pressure. d) The Vehicle is locked and secure at all times when it is not in use and the keys kept under the Renter’s personal control at all times. e) No part of the engine, transmission, braking or suspension systems are interfered with. f) Should a warning light be illuminated or the Renter believes the Vehicle requires mechanical attention, the Renter will stop driving and advise the Lessor immediately. g) Αll drivers authorised to use this Vehicle during the term of hire are aware of , understand and comply with the terms outlined in the Rental Agreement. h) Any authorised driver carries their driver’s licence with them in the Vehicle at all times and will produce it on demand to any enforcement officer.
6.LESSOR’S OBLIGATIONS
6.1 The Lessor shall supply the Vehicle in a safe and roadworthy condition, up to current certificate of fitness standards.
7.MECHANICAL REPAIRS AND ACCIDENTS
7.1. If the Vehicle is involved in an accident, is damaged, breaks down or requires repair or salvage, regardless of cause, the Renter shall notify the Lessor of the full circumstances immediately. The Renter shall not arrange or undertake any repairs or salvage without the Lessor’s authority. If the Vehicle requires repair or replacement, the decision to supply another Vehicle to the Renter is at the Lessor’s sole discretion.
8.RETURN OF VEHICLE
8.1. The Renter shall, at or before the expiry of the term of hire, deliver the Vehicle to the agreed rental location described in the Rental Document or obtain the Lessor’s consent to the continuation of the hire. If the Renter does not comply with this clause, and does not immediately return the Vehicle, the Lessor may report the Vehicle as stolen to the police and the Renter must compensate the Lessor for either the full cost of the Vehicle, or all additional costs and losses incurred up to the time that the Vehicle is recovered by the Lessor.
9.FUEL POLICY
9.1The Renter, upon delivery of the vehicle at the agreed rental location, must ensure that the fuel level is the same as upon collection. The Fuel level will be stated on the Rental Document. Failing to do so, the Lessor will charge the Renter the difference in fuel depending on the current fuel rates. Excess fuel will not be refunded. There is no refuelling fee. 9.2 As for the Battery Electric Vehicles the Lessor will ensure full charge* upon collection and will charge the difference upon return depending on the current rate of kWh. *full charge is considered from 90% and above battery capacity.
10.LIABILITY
10.1 The Renter is liable for: a) Any loss of, or damage to, the Vehicle and its accessories. b) Any consequential damage, loss or costs incurred by the Lessor, including salvage costs, loss of ability to rehire and loss of revenue; and c) Any loss of, or damage to, Vehicles and property of third parties, arising during the term of hire.
11.INSURANCE
11.1 Insurance included in the Rental agreement: a) Personal accident insurance up to 12.000€ . b) Legal insurance up to 15.000€. c) Bodily injury insurance up to 1.300.000€ per victim excluding the driver. d) Third Party insurance up to 1.300.000€. e) Uninsured Motorist Property Damage up to 30.000€. 11.2. For the insurance coverage as set out in clause 11.1 the Lessor acts only as an intermediate agent in arranging this insurance. The Renter acknowledges that the underwriter of, and/or the terms of for coverage stated in clause 11.1 may change without notice to the Renter. 11.3. Included in the rate, covered by the Lessor, and stated in the Rental Document is a collision damage waiver. The collision damage waiver reduces the Renters liability for damage to the rented vehicle to a minimum charge (hereinafter referred as ‘excess’). The excess is specified in the Rental Document and is payable for each and every incident involving the Vehicle. If the damage is excluded (see clause 12.1) the excess will be considered part payment toward the total damage cost and any additional cost will be charged to the Renter.
12. INSURANCE EXCLUSIONS
12.1. The Renter acknowledges that the cover referred to in clause 11.3. will not apply: a) When the driver of the Vehicle is under the influence of alcohol or any drug. b) For damage to the wheels, tyres, the undercarriage and/or the interior of the Vehicle. c) When the Renter fails to inform the Lessor immediately after an accident or a damage to the vehicle has occurred. d) When the Vehicle is in an unsafe or unroadworthy condition and the Renter or driver was aware or should have been aware of the unsafe or unroadworthy condition of the Vehicle. e) When a mechanical failure breakdown occurs and/or an electrical or electronic failure occurs that is the result of improper use of the Vehicle. f) When the Vehicle is driven in any motor event (i.e race, speed test,etc) g) When the Vehicle is driven by anyone not named or described in the Rental Document as a person permitted to drive the Vehicle. h) When the Vehicle is driven by an unlicensed person. i) When the Vehicle is willfully or recklessly damaged or lost by the Renter, a nominated driver, or a person under the Renter’s authority or control; j) When the driver commits a traffic offence while driving the Vehicle. k) When the Vehicle is loaded or is being loaded in excess of the manufacturer’s specifications. l) When the driver fails to stop or remain at the scene following the occurrence of an accident where required to do so by law. m) When the Vehicle was being driven on any non asphalt coated roads. n) When the Vehicle was operated beyond the term of the Rental Agreement or any agreed extension of the term, or at any other time or in any other circumstances notified by the Lessor to the Renter.
13.TRAFFIC OFFENCES
13.1. All penalties related to traffic and/or parking offences are the responsibility of the Renter.
14.CANCELLATION OF HIRE AGREEMENT
14.1 The Lessor has the right to terminate the hire and take immediate possession of the Vehicle, even without the Renter’s consent and at any given time, if the Renter fails to comply with any of the terms of the Rental Agreement. The termination of a hire under the authority of this clause shall be without prejudice to the other rights of the Lessor and the rights of the Renter under the Rental Agreement or otherwise, and the Lessor has no obligation to refund the Renter.
15. DEPOSIT FOR GUARANTEE
15.1 Upon pick up of the vehicle, a pre-authorised amount will be withheld from the driver’s credit/debit card as a deposit for guarantee which will be fully refunded at the end of the rental, provided no other charges arise. Note that the release of the pre-authorisation can take up to 30 days, depending on the issuing bank of the credit/debit card. The amount of the deposit will be equal to the excess as mentioned in clause 11.3. Cash deposits are also accepted.
16.CANCELATION POLICY
16.1 The Renter has the right to cancel his reservation, at any given time 30 days prior the agreed pick up date, without any cost. Any cancelation within the 30 days period the Lessor has the right to withhold any prepayment. During the rental term the Renter shall terminate the hire at any given time, however the Lessor has no obligation to refund the Renter.
17. PRIVACY POLICY
17.1 The information requested from the Renter is to enable the Lessor to assess the Renter’s request to hire a Vehicle. The Renter does not have to supply this information, but if the Renter does not, then the Lessor is unable to hire the Vehicle. The Renter acknowledges that the Lessor will collect, hold and use the Renter’s personal information for purposes related to the hire of the Vehicle and the provision of related customer services. The Renter further acknowledges that such personal information may be disclosed to parties involved in an accident with the Vehicle while on hire to the Renter, or any organisations responsible for the processing or handling of traffic related infringements; and the Renter hereby authorises the disclosure of their personal information for such purposes. v.1.0.191222
